These Terms of Service govern your use of the Starlight Stock Pools website and your purchase of products or services from Starlight Stock Pools ("Starlight," "we," "us," or "our").
By using our website, submitting an inquiry, requesting a quote, placing a deposit, placing an order, or purchasing products or services from us, you agree to these Terms.
If you do not agree to these Terms, please do not use the website or place an order.
Website Use
You agree to use this website only for lawful purposes and in a way that does not interfere with the operation of the site or the experience of other users.
You may not copy, reproduce, scrape, republish, distribute, or misuse any content from this website without our prior written permission, except as permitted by law.
We may update, suspend, or remove any part of the website at any time without notice.
Products and Availability
Starlight offers stock tank pools, DIY kits, wraps, lids, covers, accessories, installation-related services, and related products.
Because many of our products are built to order, custom-configured, or sourced from third-party manufacturers, product details, finishes, materials, dimensions, and included components may vary slightly from photos, renderings, or descriptions on the website.
All products and services are subject to availability. We reserve the right to change pricing, specifications, materials, included components, and offerings at any time before an order is accepted.
Quotes and Orders
Quotes, shipping estimates, and installation estimates are preliminary unless expressly confirmed by us in writing.
Submitting a form, requesting a quote, placing a deposit, or starting checkout does not automatically mean your order has been accepted.
An order is accepted only when we confirm it in writing, by invoice, by order confirmation, or by direct communication.
We reserve the right to refuse, limit, or cancel any order for any lawful reason, including pricing errors, availability issues, project feasibility concerns, suspected fraud, or inaccurate information.
Pricing and Payment
Prices shown on the website may not include freight, delivery, installation, taxes, electrical work, site preparation, permits, access-related costs, or other third-party charges unless expressly stated.
You are responsible for all applicable taxes, shipping charges, freight costs, installation-related charges, and any other costs disclosed as part of your quote, invoice, or order.
Deposits and payment terms may vary by product or project and will be reflected in the applicable product page, quote, invoice, or order confirmation.
Deposits, Cancellations, and Refunds
Deposits, cancellations, refunds, return eligibility, and damaged-item claims are governed by our Deposit & Refund Policy, which is incorporated into these Terms by reference.
By placing a deposit or order, you also agree to that policy.
Because many Starlight products are custom, freight-shipped, built to order, or scheduled for installation, cancellation and return rights are more limited than standard ecommerce purchases.
Shipping, Delivery, and Installation
Shipping, delivery, and installation dates are estimates only unless we expressly guarantee them in writing.
Delays may occur due to freight carriers, supplier availability, weather, scheduling constraints, site conditions, labor constraints, or other circumstances outside our reasonable control.
You are responsible for ensuring that your site is accessible and suitable for delivery and installation. Additional charges may apply if delivery or installation is delayed, rescheduled, or made more difficult by site access, incorrect information, customer unavailability, or other site-related issues.
Unless expressly included in writing, you are also responsible for site preparation, drainage, electrical service, plumbing, permits, leveling, and any required property modifications.
Customer Responsibilities
You are responsible for reviewing product details, confirming site fit, and ensuring that the product you order is appropriate for your space and intended use.
If you send us photos, measurements, or details about your property, our feedback is general guidance only unless we expressly agree in writing to a more specific site review or installation scope.
You are also responsible for using the product safely, following care and operating instructions, and complying with local laws, codes, HOA rules, permit requirements, and utility requirements.
Inspection and Damaged Items
You must inspect your order promptly upon delivery.
If an item arrives damaged, missing, or incorrect, you must notify us in writing within 48 hours of delivery and include clear photos and your order details.
Failure to report the issue within that period may limit our ability to file a freight claim or provide replacement, repair, credit, or other assistance.
Custom and Special-Order Items
Custom-configured pool packages, wraps, covers, fabricated accessories, special-order tanks, special finishes, and third-party items ordered specifically for your project are generally not cancelable or returnable once ordered, produced, shipped, or scheduled.
Please review your quote, invoice, and order details carefully before payment.
Warranties
Your purchase may be subject to our Limited Warranty, which is separate from these Terms and incorporated by reference where applicable.
Starlight-fabricated components and Starlight installation workmanship may be covered by our Limited Warranty.
Tank shells are agricultural products modified for pool use. Starlight warrants its own installation workmanship on drilled fittings and plumbing connections where installation is performed by Starlight. Starlight does not provide a separate written warranty on the modified tank shell unless expressly stated in writing. Any manufacturer assistance on tank-shell issues is case-by-case and may be affected by pool conversion modifications.
Heaters, pumps, filters, chillers, and other third-party equipment may be covered by the original manufacturer’s warranty instead. Manufacturer terms control those claims.
Limitation of Liability
To the maximum extent permitted by law, Starlight is not liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to the website, products, services, delivery, installation, delays, or these Terms.
This includes, without limitation, loss of use, loss of enjoyment, water loss, property damage, lost time, lost profits, travel costs, removal costs, reinstallation costs, or third-party service costs.
To the maximum extent permitted by law, Starlight’s total liability for any claim arising out of or relating to your purchase or use of our products or services will not exceed the amount paid to Starlight for the specific product or service giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
Safety and Proper Use
Pools, pumps, filters, heaters, covers, and related components involve risk if used improperly.
You are responsible for using the product safely, supervising children, following all operating and safety instructions, maintaining proper water conditions, and ensuring that installation and use are appropriate for your property.
Starlight is not responsible for injuries, losses, or damages caused by misuse, improper installation by others, lack of supervision, code violations, or unsafe site conditions outside our control.
Intellectual Property
All content on this website, including text, graphics, logos, photos, design elements, product names, and other materials, is owned by or licensed to Starlight and is protected by applicable intellectual property laws.
You may not use our content without our prior written permission.
Third-Party Products and Services
Some products, services, components, carriers, contractors, installers, or platforms referenced on our site may be provided by third parties.
Starlight is not responsible for the independent acts, omissions, delays, warranty coverage, or policies of third parties unless we expressly agree otherwise in writing.
Privacy
Your use of the website is also subject to our Privacy Policy.
Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles, except to the extent superseded by applicable federal law.
Disputes
If a dispute arises, both parties agree to first try to resolve the matter informally and in good faith.
If the dispute cannot be resolved informally, any permitted legal action must be brought in the state or federal courts located in Washington, unless applicable law requires otherwise.
Changes to These Terms
We may update these Terms from time to time by posting an updated version on this page.
The version in effect at the time of your order or use of the website will apply unless otherwise required by law.
